    Registration and Consent for RHD Vaccination
     
    I, the undersigned Owner, wish to participate in the Regional Animal Protection Society (“RAPS”) Free RHD Vaccination Program. As the owner of a rabbit (“Pet”) or Good Samaritan responsible for seeking veterinary care for the Pet identified in the online application, I certify that I am over eighteen years of age, that I have authorization to treat this Pet and hereby consent to the vaccination of this Pet by RAPS veterinarian or staff.I understand that RAPS has one vial of vaccination good for approximately fourty five vaccinations. Once the vaccine is constituted, RAPS has 2-3 minutes to vaccinate each rabbit. I agree and understand that there are very restrictive time limitations and restrictions related to administering the vaccination. I also agree:

    1. To be no less than twenty minutes early for my appointment. If I am late by even one minute, my place will be forfeit and I will not receive a vaccination as part of this program.
    2. If I am late for my appointment, RAPS will give away my vaccination to another pet owner
    3. If I am late, I will immediately vacate the premises to make room for the other people who are getting the vaccination.
    4. That being on time is my sole responsibility regardless of circumstances and not the fault of RAPS.
    5. That I have provided the proper information during registration truthfully and honestly and that any conflicting or false information makes me ineligible for this program.
    6. That if I am attending this event as a waiting list patient, there is no guarantee that my Pet will receive a vaccination treatment.
     
    I understand that RAPS is providing this service for free. I understand that:

    1. RAPS, and you, are equally relying on the positive outcome of the vaccination of your Pet. You agree that RAPS acquired the vaccination from third party suppliers, same as the other veterinary clinics in the region, and that RAPS cannot guarantee or verify the quality of the vaccination for the immunization of your Pet.
    2. The vaccination is an attempt to prevent your Pet from acquiring RHD, but RAPS cannot guarantee that your Pet does not already have RHD, that your Pet will not acquire RHD during the onset period or that your Pet may acquire RHD regardless of receiving the vaccination from RAPS.
    3. The vaccination provided will not take affect and have an onset of seven days
    4. I understand that the immunity from the vaccinations is good for twelve months
    5. There are or may be side effects associated with the vaccine 
      1. very common: a temporary increase in body temperature of up to 1.6C can be observed one day after vaccination
      2. common: immunization if followed by a limited local reaction (subcutaneous nodule up to 3mm in diameter) which may be palpable and observation for at least 52 days
    6. RAPS has the right, at time of treatment, to refuse treatment for any reason whatsoever at RAPS’ sole discretion. If RAPS deems you, the Owner, as uncooperative, unmanageable, wasting RAPS time (we have only 2-3 minutes to apply each injection for the vaccine to be effective for all recipients), if your Pet is dangerous or uncooperative, or for any reason whatsoever, RAPS can refuse treatment, at RAPS’ sole discretion.
    7. That my pet is to remain in my car at all times.
    8. That my pet must be in a carrier and available for vaccination when told by RAPS staff to be ready. I agree that once RAPS is available to administer the vaccination, that RAPS will not wait more than twenty seconds for my Pet to be ready for the process of administering the vaccination.
    9. That the vaccination shall be administered inside my vehicle.
    10. That I will follow all instructions of RAPS’ staff during the vaccination process.
    11. That I will not interfere in any way with the application and administering of the vaccine to my Pet.
    12. I understand that RAPS’ DVM may refuse application or administration of the vaccine to my Pet for any reason whatsoever.
    13. That some risks always exist with any type of medical procedure, including vaccinations. I give full authority to the RAPS staff to handle my Pet and provide such treatment as necessary to administer the vaccine, without any interference by me.
    14. I accept that veterinary medicine is an inexact science and that no guarantee of successful treatment has been made by administering of the vaccine.
    15. That despite all precautions being taken, there is a risk that RHD virus could be transmitted between vehicles.
    16. That I, as a Pet Owner, have taken bio-security measures (and quarantine) prior to my Pet being vaccinated
    17. That I shall not register for this vaccination program by RAPS unless I am willing to bring my Pet to the assigned out door clinic.
    18. I agree to be part of RAPS’ contact list upon signing up for this program and provide express consent for RAPS to contact me by phone, cell, text, e-mail, social media or fax.
    19. Indemnity.  Without limitation and in addition to any rights of RAPS against the Owner arising by reason of any breach of this Agreement, the Owner will be liable to RAPS (except for negligence on RAPS’ part) for all losses, costs (including legal costs on a solicitor and its own client basis), damages and expenses whatsoever which RAPS may suffer, sustain, pay or incur; and in addition will indemnify RAPS against all actions, proceedings, claims, demands, losses, costs (including legal costs on a solicitor and its own client basis), damages and expenses whatsoever which may be brought against or suffered by RAPS or which it may sustain, pay or incur, arising or resulting from a breach of this Agreement or the actions of the Owner.
    20. Remedies for Breach.  It is understood that a breach of any of the covenants or provisions contained in this Agreement may cause RAPS to suffer loss or damage that could not be adequately compensated for by monetary award or damages, and that, in addition to claiming damages or indemnity in respect thereof, RAPS will be entitled as a matter of right to seek an injunction or other equitable relief to prevent or cure any breach or threatened breach of this Agreement or to enforce specifically the terms and provisions hereof, and the Owner agrees RAPS will suffer irreparable harm as a result of a breach of any of the covenants or provisions contained herein, and the Owner consents to any preliminary or ex parte applications for such relief to any court of competent jurisdiction.  Further, such right will be cumulative and be in addition to any other remedies which may be available to RAPS.
    21. Notices.  Due to time constraints and limitations for administering the vaccinations, any notices to be given by either party to the other will be sufficiently given if delivered by e-mail. It is the sole responsibility of the Owner to contact RAPS if they have not received a communication form RAPS.
    22. Governing Law.  This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, and the parties attorn to the exclusive jurisdiction of the courts of the Province of British Columbia and no other courts.
    23. Severability.  If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, it will be deemed not to affect or impair the validity of the remaining provisions hereof.  For the purposes of this section, “provision” means any severable section, sentence, phrase or word which least alters the intent of the parties to this Agreement.
    24. Modifications and Waivers.  No modification or waiver of any of the provisions of this Agreement will be effective unless in writing and signed by the party consenting to the modification or waiver.  No failure or delay by any party in exercising any right, power or privilege under this Agreement will operate as a waiver thereof, nor will any single or partial exercise of any right, power, or privilege hereunder.
    25. Submission of Agreement – this Agreement shall be deemed valid and having been executed and delivered by the Owner to RAPS through the online application submission form for Registration and Consent for RHD Vaccination.
    26. Counterparts.  This Agreement may be executed in counterparts that together will be deemed to constitute one valid and binding agreement, and delivery of the counterparts may be effected by means of an online submission form by the Owner or email transmission with the same effect as if original copies had been delivered.
